In October 1995 the 1971 Fund Executive Committee reiterated its position from its 42nd session that the Fund could only pay compensation to the extent that the claimant had demonstrated an actual loss supported by evidence which would enable the Fund’s experts to form an independent opinion on the damage sustained. The Committee stated that, although a certain flexibility would have to be execised as regards the application of the requirement of proof, the criteria laid down at that session should be respected.
