In June 2005 the 1992 Fund Executive Committee decided to instruct the Director to make a refined provisional estimate of the total amount of admissible claims arising from the incident in each of the three States concerned, and that on that basis, he should submit a proposal to the Committee on a provisional apportionment between those States of the maximum amount payable by the 1992 Fund so as to enable the Committee to take a decision on such an apportionment and whether the level of the Fund’s payments could be increased and, if so, what the new level of payments should be, subject to guarantees against overpayment.
