In October 2003 the 1992 Fund Executive Committee, recalling that the French Government had given an undertaking only to pursue its claim if and to the extent that all other claims (apart from those of Total Fina Elf) had been paid in full, noted that, although there remained considerable uncertainties as to the total amount of established claims, it might be possible in the near future to make payments in respect of the French Government’s claim. The Committee therefore decided to authorise the Director to make such payments to the extent that he considered there was a sufficient margin between the total amount of compensation available and the Fund’s exposure in respect of other claims.
