In May 2002 the 1992 Fund Executive Committee and the 1971 Fund Administrative Council considered the admissibility of claims for the costs associated with the construction and removal of a 175 metre causeway from the shore to the upturned bow section to facilitate the removal of oil using road tankers. The Executive Committee and the Administrative Council agreed that the serious risk of pollution from the bow section justified the decision by the Japanese authorities to commence the construction of the causeway, but that the decision should have been reappraised in the light of the difficulties faced as a result of adverse weather, which caused sections of the causeway to be washed away on three separate occasions. The 1992 Fund Executive Committee and the 1971 Fund Administrative Council decided to approve costs corresponding to the estimated costs of constructing the causeway up to the time when, in the view of the Fund’s experts, the construction work should have been terminated and the subsequent removal costs.
