In April 1999 the 1992 Fund Executive Committee decided that, taking all factors into account, the Marine Emergency Mutual Aid Centre (MEMAC) had taken all reasonable steps to pursue the legal remedies available to it and that MEMAC’s claim was therefore admissible. The Committee emphasised that in future similar cases it would be important to examine carefully whether, in the light of the particular circumstances of the case, the claimant had taken all reasonable steps to pursue the legal remedies available.
