In October 2010, the 1992 Fund Executive Committee noted that in its judgement made at a hearing in October 2010, the Arbitration Court of Saint Petersburg and Leningrad Region had decided that the spill had not resulted from a natural phenomenon of an exceptional nor inevitable character and that the shipowner and his insurer were therefore liable for the pollution damage caused by the spill.
