In October 2008 the 1971 Fund Administrative Council noted that the claims for compensation had been transferred to the maritime court of first instance and that the shipowmer had submitted pleadings arguing that one of the claims had lapsed according to Venezuelan law, that the Court had denied the petition and that the shipowner had appealed against the ruling.
