In June 2008 the 1992 Fund Executive Committee noted that in November 2007 the Kobe Marine Accident Inquiry Agency had delivered its judgement on the cause of the incident in which it had held that the collision occurred mainly because the other ship involved, the Trust Busan, had failed to maintain proper lookout and had turned to port contrary to the regulation under which it was required to alter its course to starboard, but that the Shosei Maru had also failed to take early action to alter its course to starboard. It was noted that no decision had been taken as to the apportionment of liability between the two ships involved.
