In October 1996 the 1971 Fund Executive Committee decided that, since the investigation carried out by the Korean Marine Accident Inquiry Agency into the cause of the incident did not give any indication that the incident had occured as a result of the actual fault or privity of the shipowner, the 1971 Fund should not challenge the shipowner’a right to limit his liability.
