In June 2005, recalling that the Spanish State had taken legal action against the American Bureau of Shipping (ABS) in the Federal Court of first instance in New York and that the Committee had decided in October 2004 that the 1992 Fund should not take recourse action against ABS in the United States, renewed the instructions to the Director to follow the ongoing litigation in the United States, monitor the ongoing investigations into the cause of the incident and take any steps necessary to protect the 1992 Fund’s interests in any relevant jurisdiction
