In February 2006 the 1992 Fund Assembly decided to establish an intersessional Working Group on non-technical measures to promote quality shipping for the carriage of oil by sea. It was decided that the Working Group should focus on, inter alia, the development of common criteria to be uniformly applied by Member States to ensure that fully effective insurance was in place before States issued CLC certificates, identifying factors that prevented the sharing of information between marine insurers and the development of policies or other measures to facilitate such sharing of information and possible measures for the denial or withdrawal of insurance cover in order to promote safe transportation of oil. It was decided that both State and industry representatives and the International Maritime Organization (IMO) should be encouraged to participate. It was emphasized that the Working Group should not stray into the areas of competence of IMO and should not consider issues that would require any reopening of discussions regarding a revision of the 1992 Civil Liability Convention and the 1992 Fund Convention.
