In March 2006 the 1992 Fund Executive Committee noted that in December 2005 the Commercial Court in Lorient had rendered a judgement in respect of a claim by the owner of a bar in Carnac for losses in 2000, which had been rejected by the Fund on the grounds that there had not been a sufficient link of causation between the alleged losses and the contamination, nor had the claimant proved that he had suffered any loss. It was noted that the claimant had commenced the action on 8 September 2003 and that the Fund had argued that as regards losses before 8 September 2000 the claim was time-barred. The Committee noted that the Court, which did not address the issue of time bar, had rejected the claim on the grounds that the claimant had not proved that he had suffered any loss. It was noted that the claimant had appealed against the judgement.
