Decision ID: 001795
In October 2005 the 1992 Fund Executive Committee, recalling that the Swedish Government had taken legal action in the Stockholm District Court against the owner of the tanker Alambra and the insurer of the vessel, that the shipowner and the insurer had maintained that the oil did not originate from the vessel and that the Government had also taken legal action against the 1992 Fund invoking the liability of the Fund to compensate the Government if neither the shipowner nor the insurer were held liable to pay compensation. It was noted that at the request of the 1992 Fund the District Court had decided that the action against the Fund should be suspended until the action against the shipwowner and the insurer had been heard. It was furter noted that, at the request of the owner and the insurer, the Court had granted a postponement of the proceedings to give the parties time to negotiate an out-of-court settlement.
