In October 2005 the 1992 Fund Executive Committee noted that in June 2005 the Commercial Court in Rennes had rendered a judgement in respect of claim for additional costs incurred by a Chamber of Commerce in analysing seawater for oil pollution in ports along the coast of South Finistère and for the increased consumption of fresh water used to clean up the fish stalls of a fish auction hall. It was noted that in its assessment of the claim the Fund had excluded the cost of seawater analyses that had been carried out in two ports located outside the area affected by the contamination. The Committee noted that the Court had agreed with the Fund’s assessment of the part of the claim relating to increased consumption of fresh water, but had held that seawater analyses were justified even in unpolluted ports and that the costs should be included in the assessment. It was noted that at the request of the Court, the Fund’s experts had reassessed the claim for seawater analyses in line with the Court’s decision and a settlement proposal would be forwarded to the claimant.
