In June 2005 the 1992 Fund Executive Committee noted that in February 2005 the Civil Court in Paris had rendered a judgement in respect of a claim by a company selling post cards and posters in Brittany for losses allegedly suffered as a result of the incident. It was noted that the claim had been rejected by the Fund on the grounds that the claimant supplied goods and services to other businesses in the tourist sector but not directly to tourists, and that therefore there was not a sufficiently close link of causation between the contamination and the alleged loss. The Committee noted that the Court had specifically referred to the Fund’s criteria for admissibility of claims for pure economic loss, and had held that since the claimant did not sell goods directly to tourists and did not sell them only to businesses in Brittany, but also to a large extent to businesses in other parts of France, the claim did not fulfil the Fund’s criteria and therefore rejected the claim.
