In October 2002 the 1971 Fund Administrative Council noted that Texaco, which operated an oil terminal in MIlford Haven had commenced legal action against the Milford Haven Port Authority (MHPA) on similar legal grounds as those invoked by the 1971 Fund. It was noted that Texaco had also taken legal action against Milford Haven Pilotage Ltd (MHPL), the company which employed pilots working in the port of Milford Haven, and that it had raised the same arguments against MHPL and MHPA that the Fund had raised against MHPA in respect of pilotage allocation and pilot training. It was further noted that Texaco had also argued that MHPA and MHPL had created or caused a public nuisance resulting in the said losses.
