In October 2002 the 1992 Fund Executive Committee and the 1971 Fund Administrative Council decided that the 1992 Fund and the 1971 Fund respectively should pursue recourse actions against the shipowner. The governing bodies recognised that their decisions in this particular case represented a deviation from the Funds’ policy of basing their decisions in part on the prospects of recovery in the event of a favourable judgement.
