In October 2001 the 1992 Fund Executive Committee noted that the Director had held informal discussions with the insurer of the Kuzbass as regards the evidence linking the Kuzbass to the pollution of the German coast, but that the insurer had continued to maintain that the vessel was not to blame. The Committee agreed that the issues relating to liability would therefore have to be decided by the German Courts.
