In October 2000 the 1992 Fund Executive Committee considered the admissibility of a claim by a manufacturer of nets and other fishing equipment for a reduction in sales during the period following the incident. The Committee noted that the claimant’s business was located some 100 km south of the area affected by the spill and that a considerable part of his sales were to businesses which in their turn sold nets and other fishing equipment to fishermen operating in the affected area. The Committee considered that, since the claimant’s business was located some distance outside the area affected by the spill, it could not be considered an integral part of the economic activity within the affected area and that there was therefore not a reasonable degree of proximity between the alleged losses and the contamination. The Committee also took the view that there had not been any general ban imposed on fishing that could have caused a reduction in sales of the claimant’s products. The Committee decided therefore that the claim should be rejected.
