In February 1999 the 1992 Fund Executive Committee instructed the Director to examine whether the 1992 Fund should pursue recourse action against the shipowner if further steps by the claimant, the Marine Emergency Mutual Aid Centre (MEMAC) to obtain compensation proved unsuccessful. The Committee considered that in taking that decision it would be necessary to take into account whether the costs which would be incurred in any recourse action were justified in view of the low amount which could be recovered.
