In February 1999 the 1971 Fund Executive Committee, noted that the shipowner had paid the limitation amount into court and that he was not prepared to make any payments to claimants as well. It was also noted that the claimants would have to wait a long time before receiving payments if the 1971 Fund were to wait for the completion of the limitation proceedings and the distribution of the limitation fund. In view of the relatively small amounts involved, the Committee decided that the 1971 Fund should pay all established claims in full and present subrogated claims against the shipowner’s limitation fund.
