In February 1999 the 1971 Fund Executive Committee, recalling that the Canadian Government had taken legal action against the owners and operators of the vessel (which sank in 1970) claiming compensation for the cost of refloating the vessel in 1996 and that the Canadian Government had notified the 1971 Fund of the legal action, noted that in December 1998 the Canadian Court had dismissed the action against the Fund on the grounds that the Fund could not be liable for events that had occurred prior to the entry into force of the 1971 Fund Convention in respect of Canada.
