In February 1999 the 1971 Fund Executive Committee, recalling that the Spanish Government, for constitutional reasons, was not prepared to make a written committment that the Spanish State was in any event liable to pay the total amount of established claims in excess of the total amount available under the 1969 Civil Liability and 1971 Fund Conventions,namely 60 million Special Drawing Rights,and in view of the high degree of uncertainty as to the total amount of the established claims, re-confirmed its position that payments by the Fund to the claimants who had been awarded a specific amount in the judgements by the Court of first instance and the Court of Appeal should be limited to 40% of the respective amounts awarded.
