In October 1998 the 1971 Fund Executive Committee considered the question as to whether the spilled oil fell within the definition of ‘oi’ in Article 1.5 of the 1969 Civil Liability Convention, which covered only persistent oil. The Committee recalled the Fund’s guide to the nature and definition of persistent oil and noted that the analysis of the oil of the oil taken from one of the vessel’s cargo tanks had shown that the oil was non-persistent. The Committee decided that for this reason the incident fell outside the scope of application of the Conventions.
