In October 1998 the 1971 Fund Executive Committee noted, in a private session at which only the delegations of the Member States of the 1971 Fund and of 1992 Fund were present, that on the basis of the Japanese and Russian reports on investigations into the cause of the incident, the Fund’s experts had concluded that the vessel had been improperly maintained and had therefore been unseaworthy. The Committee instructed the Director to complete his investigation into the cause of the incident as soon as possible so as to enable the Committee to take a decision as to whether a recourse action should be pursued. The Director was also instructed to establish the status of the Russian and Japanese Reports.
