In February 1998 the 1971 Fund Executive Committee decided, in view of the uncertainty as to whether the total amount of the claims might exceed the total amount available under the 1969 Civil Liability and 1971 Fund Conventions, that for the time being the level of the Fund’s payments should be limited to 50% of the loss or damage actually suffered by each claimant, as assessed by the experts appointed by the Fund at the time the payment was made.
