In October 1997 the 1971 Fund Executive Committee, whilst noting that it was possible that the total amount of the claims would not exceed the shipowner’s limitation amount, nevertheless decided to authorise the Director to approve final settlements on behalf of the Fund of all claims arising out of the incident, to the extent that they did not give rise to questions of principle that had not previously been decided by the Committee. It was noted that the Director had not requested authorisation to make any payments for the time being given the uncertainty as to the total amount of the claims.
