In October 1996 the 1971 Fund Executive Committee reiterated the view that it was not acceptable to calculate the shellfish harvesters’ losses using the maximum allowable harvest days and the maximum allowed quantities and also reinterated that under the Conventions compensation was payable only for losses actually suffered and that claimants had to prove their losses. For these reasons the Committee decided that the Fund could not accept the proposal for a settlement made by the claimants’ lawyer.
