In October 1996 the 1971 Fund Executive Committee endorsed the Director’s analysis of the Fund’s right of recourse under Article 9.2 of the Fund Convention and his statement that the question of whether the ship’s pilot was liable would be decided by the Court of Appeal, as would the question of whether the Spanish State was liable for the acts of pilots, whether the State could be made liable for the damage resulting from the incident and, therefore, whether or not the Fund had any grounds for recourse action. The Committee decided to revert to the issue of whether the Fund should pursue a recourse action against the Spanish State after the Court of Appeal had rendered its judgement.
