In October 1995 the 1971 Fund Assembly endorsed the statement by the Japanese delegation as the position of the 1971 Fund in relation to the Haven incident, namely that, since there had been no further reaction by the Italian Government on the offer by the shipowner/insurer and the 1971 Fund of a global settlement, any future initiatives towards a global settlement must be taken by the claimants, including the Italian Government; should the claimants, including the Italian Government, wish to revert to a settlement on the terms of that offer, the matter would have to be referred to the Assembly for decision.
