In June 1996 the 1971 Fund Executive Committee, noting the disproportionally high legal costs that would be incurred in establishing the limitation fund in respect of this incident compared with the low limitation amount under the 1969 Civil Liability Convention in this case, decided that the requirement to establish the limitation fund should be waived in this case, so that the Fund could, exceptionally, pay compensation and indemnification without the limitation being established.
