In June 1996 the 1971 Fund Executive Committee decided that the Fund should retain its policy that compensation should be paid only for losses that had already been suffered. It was also decided that claims for future losses that became the subject of legal proceedings should be opposed by the Fund on the basis that the Civil Liability and Fund Conventions did not allow such claims, recognising that there was no certainty that courts in Member States would accept the Fund’s position, although in the Committee’s view, courts should take into account the importance of a uniform application of the Conventions.
