In October 1993 the 1971 Fund Executive Committee decided that the losses allegedly suffered by a car repair firm as a result of the closure by the authorities of the area in which it was located to facilitate clean-up operations should be considered as damage caused by preventive measures and that the claim for such losses was admissible in principle.
