In October 1992 the 1971 Fund Executive Committee authorised the Director to take recourse action against the owner of the colliding vessel (Moby Prince) to recover any amount paid by the Fund as a result of the incident, unless the findings of the investigation into the cause of the incident being carried out by the Italian autthorities were to show that there were no grounds for such action. The Committee instructed the Director to re-examine this issue in the light of the findings of the investigation, and to submit to the Committee for consideration the question of whether recourse should be pursued, even if he were to find that the amount which the Fund might recover would be comparatively low.
