In October 1994 the 1971 Fund Assembly endorsed the report by the Working Group. It was agreed in general to maintain the policy applied by the 1971 Fund, which excluded claims for costs of studies of a general or purely scientific nature. It was accepted that studies were sometimes necessary to establish the precise nature and extent of pollution damage and/or the need for reinstatement measures, in which case, it would be appropriate for the Fund to contribute to the costs of such studies, provided inter alia, they related to ‘pollution damage’ as defined in the Conventions or reasonable measures of reinstatement.
