In February 1998 the 1971 Fund Executive Committee noted that the 1971 Fund would intervene in the proceedings before the Criminal Court in Cabimas. In response to a statement by the Venezuelan delegation that it would be inappropriate and unacceptable for an international organisation to intervene in a criminal court, the Director drew attention to the fact that the proceedings had two aspects, one relating to the criminal action against the master and one regarding compensation for pollution damage. The Committee endorsed the Director’s understanding that the 1971 Fund was entitled to intervene in the aspects regarding civil liability and the correct interpretation and application of the 1969 Civil Liability Convention and the 1971 Fund Convention.
