In March 2007 the 1992 Fund Executive Committee noted that in December 2006 the Commercial Court in La Roche sur Yon had rendered a judgement in respect of a claim by an estate agent in Saint Jean de Monts for losses in letting property to tourists in 2000 and 2001 allegedly due to the incident, which the Fund had rejected on the grounds that the claimant had failed to establish that there had been a link of causation between the reduction in income and the incident. It was noted that the Court, after stating that the Fund’s admissibility criteria were not binding on the judge, had agreed with the Fund that the reduction in income was a result of factors unrelated to the incident and that the claimant had not proved a link of causation between the loss and the incident.
