In May 2006 the 1992 Fund Executive Committee noted that in April 2006 the Commercial Court in La Roche-sur-Yon had rendered a judgement in respect of a claim by the operator of a camping site for losses allegedly incurred in 2000 and 2001 due to the pollution. It was noted that the Fund had assessed and approved the losses in 2000, but for a lower amount than claimed, and had rejected the claim for losses in 2001 on the grounds that there had not been a sufficient link of causation between the alleged losses and the contamination resulting from the incident. It was noted that the Court had accepted the Fund’s assessment of the losses in 2000 and had rejected the claim for 2001 on the same grounds as the Fund.
