Decision ID: 001895

In May 2006 the 1992 Fund Executive Committee noted that in March 2006 the Commercial Court in Quimper had rendered a judgement in respect of a claim by a fisherman based in Camaret-sur-mer, North Brittany, which had been rejected by the Fund since claimant’s home port and his normal fishing grounds had not been affected by the pollution, and that fishing in December 1999 had been cancelled due to bad weather. The Committee noted that the Court had rejected the claim on the grounds that the claimant had not proved that there was a link of causation between the alleged loss and the pollution resulting from the incident.
