In May 2004 the 1992 Fund Executive Committee noted that in April 2004 the Commercial Court in Rennes has rendered a judgement in respect of a claim for a reduction in sales by a company in Rennes that carried out activities as a tour operator selling hiking tours in Brittany, Ireland and the Channel Islands and as a traditional travel agency. It was noted that the claim had been rejected by the 1992 Fund on the grounds that sales through other tour operators were second degree tourism claims and that no loss had been proven as regards sales direct to tourists. It was noted that the Court had rejected the claim on the basis of the 1992 Conventions, which the Court held took precedence over French laws, and on the basis of the 1992 Fund’s admissibility criteria.
