In July 2000 the 1992 Fund Executive Committee noted that the owner of a taxi boat in Concarneau had taken legal action by way of summary proceedings against the shipowner, the vessel management company, the insurer and Total Fina in the Tribunal de Commerce in Dunkirk, claiming £100 000 for loss of income for three years. It was noted that the 1992 Fund had intervened in the proceedings to protect its interests. It was noted that in April 2000 the Court had declined jurisdiction on the grounds that that the claimant had not presented a good arguable case. It was also noted that the claimant had subsequently brought legal action in the Tribunal de Grande Instance de Sables d’Olonne against the same four defendants and that the Fund intended to oppose this action.
