In October 1997 the 1971 Fund Executive Committee, in the light of the Court of Appeal’s decision to uphold the first instance Criminal Court’s decision regarding the civil liabilities of the parties concerned, considered whether to pursue a recourse action to claim reimbursement from the other defendants so that ultimately the master/shipowner’s insurer/1971 Fund would pay 50% and the pilot/Spanish State would pay 50% of the amounts awarded to claimants. The Committee decided to postpone its consideration of the question of recourse until a later session and instructed the Director to obtain a second opinion in relation to the interpretation of the judgement in respect of the distribution of liabilities between the parties involved.
