Decision ID: 000724

In April 1997 the 1971 Fund Executive Committee reconsidered a claim by a haulage company for loss of income as a result of the company not being able to use a specialised vehicle to transport whelks from Saundersfoot (located in the area affected by the fishing ban imposed by the United Kingdom Government) and transport them to a fish processor. The Committee noted that the oil spill had affected the use of only one of the claimant’s 11 vehicles and therefore took the view that the claimant was only to a limited extent dependent on the affected resource. The Committee also considered that only a minor part of the claimant’s business formed an integral part of the economic activity within the area affected by the spill. For these reasons the Committee took the view that there was not a reasonable degree of proximity between the contamination and the alleged loss and therefore decided to reject the claim.
