In October 1995 the 1971 Fund Executive Committee considered a claim by P&O Scottish Ferries Ltd for loss of income from its ferry service between Aberdeen and Shetland allegedly as a result of a reduction in the number of tourists visiting Shetland and a reduction in the volume of freight. The Committee decided to reject the claim on the grounds that the criterion of reasonable proximity was not fulfilled in that there was not sufficient proximity between the claimant’s activity and the contamination and the business did not form an integral part of the economic activity of Shetland.
