In May 1994 the 1971 Fund Executive Committee decided that payments made to fishermen and shellfish gatherers by the Fisheries Council of the Region of Galicia, which were in the nature of a gift (humanitarian aid), should not be taken into account when determining the amount of compensation payable under the Conventions. The Committee further decided that payments made by the Commission of the European Community through one Directorate should be deducted from any compensation payable by the Fund, since they related to losses, which in principle, if proven, would qualify as compensation under the Conventions, whereas payments made through another Directorate should not be deducted because they were in the nature of a gift.
