In June 1997 the 1971 Fund Executive Committee decided that since the spilled oil had entered one of the vessel’s cargo holds and then overflowed from the hatch of that hold, the Conventions’ criterion of being ‘carried on board as cargo’ had been fulfilled and the incident therefore fell within the scope of application of the 1969 Civil Liability and 1971 Fund Conventions.
