In February 1994 the 1971 Fund Executive Committee recalled that it had at its 36th session decided that, in view of the total amount of the claims presented in court, and in order to ensure that the provisions of Article 4.5 of the 1971 Fund Convention relating to equal treatment of claimants was respected, the Fund’s payments should not exceed 30-40% of the amount approved. The Committee noted the Director’s decision to limit any payment, at least for the time being, to 25% of the established damage suffered by the claimant concerned.
