In October 2000 the 1971 Fund Administrative Council decided that in cases where it was clear either from an early stage or subsequently that the total amount of the established claims would not exceed the shipowner’s limitation amount, it would not normally be possible for the 1971 Fund to pay claimants and thereafter present a claim for reimbursement from the shipowner/insurer.
