In October 2002 the 1971 Fund Administrative Council, noting that in respect of the action by the 1971 Fund against Milford Haven Port Authority, the Court might order the use of alternative dispute resolution, such as mediation and conciliation, instructed the Director to take a flexible approach to any such proposal by the Court.
