In October 2000 the 1971 Fund Administrative Council, recalling that the case had been referred back to the Court if first instance to decide on the merits of the case as regards the direct action taken by the Fund against the insurer, noted that in a judgement in March 2000 the Court of first instance had ordered the insurer to pay the 1971 Fund £771,000 plus interest. It was noted that the insurer had appealed against the judgement.
